How to kill ICC? Ask USA

Prosecutor of International Criminal Court Karim A. Khan got an arrest warrant issued by the judges of the Court against Vladimir Putin on Fri, Mar 17, 2023 accusing him of unlawfully deporting thousands of Ukrainian children, from Russian annexed territory to mainland Russia, citing it as war crime. Just little optics. But, who is the hidden hand?

Ostensibly, the West led by America is found as the prime mover. What exactly USA wants to happen? Originally, ICC was incorporated consequent to the adoption of the Rome Statute on 17 July 1998. About 123 countries are Parties to the Rome Statute. Yet major players who opted out included China, Ethiopia, India, Indonesia, Iraq, North Korea, Saudi Arabia & Turkey.

America was appalled by the inauguration of ICC, as it was going against the mantle of US exceptionalism and her policy that Americans cannot be tried elsewhere in the globe. Put it in perspectives, USA crimes should never be investigated by ICC. However, in order to show fake fairness U.S. President Bill Clinton signed the Rome Statute in 2000, but never ratified. Having signed it USA had afterthoughts and withdrew its signature and indicated that it did not intend to ratify the Agreement.

Mulling for quite some time how to kill International Criminal Court, America got finally a chance to finish the job in the Ukraine theatre. Citing unverified crime by Vladimir Putin of unlawfully deporting thousands of Ukrainian children, from Ukraine to Russia proper, she got her Ally Britain to move a motion in the ICC to issue a warrant against Putin.

There were two aims of this business manoeuvre: one is to embarrass Russia and her President. Other is the most ominous. Countries that are parties to the Rome Statute cannot invite Putin or allow him to land in their soil as they are legally obliged by ICC rules to arrest and hand him over to ICC. That would result in the exodus of signatory countries from the Rome Statute.

As expected it has begun. South Africa was first to call it out. Of the original signatories 33 are form Africa. The continent is seething with anger because more Africans were sentenced for crimes than any other. Before long Asia, and Latin America would join the queue for quick exit. ICC therefore is doomed and that was what USA precisely wanted!
